We may update our cookie controls, technology providers and this Privacy Policy as our technology stack changes.

Depending on the circumstances and applicable law, this processing may be based on your consent or another lawful basis available to Insight.

Where applicable law requires prior consent for marketing communications, we will rely on such consent before sending those communications.

You may object to or withdraw from marketing communications at any time.

You can do this by:

  • Using an unsubscribe option included in a marketing communication, where available;
  • Emailing us at hello@insightscaling.com; or
  • Contacting us through our WhatsApp communication channel and asking not to receive further marketing communications.

8. Legal Bases for Processing

Where the GDPR applies, Insight may process personal information under one or more of the following legal bases:

Consent
Where you have specifically agreed to processing, including certain marketing communications and non-essential tracking technologies.

Pre-contractual measures and contractual necessity
Where processing is necessary to respond to a request made by you before entering into an agreement or to perform an agreement with you.

Legitimate interests
Where processing is reasonably necessary for Insight's legitimate business interests and those interests are not overridden by your rights and freedoms. This can include business administration, improving our services, protecting our systems and, where legally permitted, certain business-to-business marketing activities.

Legal obligation
Where processing is necessary for Insight to comply with applicable legislation, accounting obligations, tax requirements, regulatory obligations or lawful governmental requests.

9. Sharing of Personal Information

Insight may share personal information with service providers where reasonably necessary to operate our business.

These may include providers of:

  • Scheduling and calendar systems;
  • Cloud storage;
  • Business productivity software;

These companies may process information according to their own privacy policies or on behalf of Insight under appropriate contractual arrangements.

We may also disclose information where required by law, regulation, court order or other lawful request, or where reasonably necessary to protect our rights or the rights of others.

10. International Data Transfers

Some of the service providers used by Insight may process or store information outside Portugal or the European Economic Area.

Where personal information is transferred internationally and the GDPR applies, we take appropriate measures where required to ensure an adequate level of protection.

Depending on the circumstances, these protections may include European Commission adequacy decisions, Standard Contractual Clauses or other legally recognised transfer mechanisms.

11. Data Retention

Insight does not intend to retain personal information indefinitely.

As a general rule:

Prospective clients and enquiries:
Information relating to enquiries, calls and prospective business relationships may generally be retained for up to 24 months following the last meaningful interaction, unless there is an ongoing business reason or lawful basis to retain it for longer.

Marketing information:
Information used for marketing may be retained until you withdraw your consent, object to the processing or the information is otherwise no longer reasonably required. We may periodically remove inactive marketing records.

Client information:
Information concerning active and former clients may be retained for the duration of the business relationship and afterwards where reasonably necessary for contractual, accounting, tax, legal, dispute-resolution or record-keeping purposes.

Legal and accounting records:
Information contained in records that Insight is legally required to retain will be maintained for the applicable statutory retention period.

Analytics and tracking information:
Retention periods for cookies, identifiers and analytics data may vary depending on the relevant provider, configuration and cookie settings.

When information is no longer required for the purpose for which it was collected and there is no legal reason requiring continued retention, we will delete, anonymise or otherwise securely dispose of it.

12. Your Data Protection Rights

Depending on the circumstances and applicable law, you may have the right to:

  • Request confirmation as to whether we process your personal information;
  • Request access to personal information we hold about you;
  • Request correction of inaccurate or incomplete information;

  • Withdraw consent where processing is based on consent;
  • Request portability of eligible information;
  • Lodge a complaint with a competent data protection authority; and
  • Exercise other rights provided by applicable data protection legislation.

Withdrawal of consent does not affect the lawfulness of processing performed before consent was withdrawn.

13. Requests to Delete Your Information

If you have provided personal information to Insight and would like us to delete it, you may contact us:

  • By email at hello@insightscaling.com; or
  • Through our WhatsApp communication channel.

Where a valid erasure request applies, Insight will aim to remove the relevant personal information from its active operational and marketing systems within a maximum of 72 hours after receiving and verifying the request.

This 72-hour commitment does not apply where Insight is legally entitled or required to retain particular information, including where records must be kept for tax, accounting, contractual, fraud-prevention, dispute or legal-claim purposes.

Information may also remain temporarily within secure system backups until those backups are automatically overwritten or deleted according to normal backup-retention procedures, provided that such information is not restored or actively processed except where necessary for recovery or legal purposes.

14. Marketing Opt-Out Requests

Your right to object to direct marketing is unconditional.

If you ask Insight to stop using your personal information for direct marketing, we will honour the request.

We may maintain the minimum information necessary to record that you have opted out so that we do not inadvertently add you to future marketing campaigns.

15. Security

Insight takes reasonable technical and organisational measures designed to protect personal information from unauthorised access, disclosure, alteration, loss, misuse or destruction.

However, no website, electronic communication method or storage system can guarantee absolute security.

16. Third-Party Platforms

If you interact with Insight through a third-party platform such as WhatsApp, Meta, Instagram, LinkedIn, Google, TikTok or another service, that platform may independently collect and process information about you.

Your use of those platforms is also subject to the relevant provider's own terms and privacy practices.

Insight is not responsible for the independent processing activities of third-party platforms where those providers act as separate data controllers.

17. Automated Processing and Advertising Audiences

Some advertising and analytics platforms may automatically process website interaction data to measure conversions, attribute advertising activity or place users into advertising audiences.

Insight may use these capabilities for marketing and advertising purposes where legally permitted.

Insight does not use website tracking data to make decisions based solely on automated processing that produce legal effects or similarly significant effects concerning individuals.

18. Children's Privacy

Insight's website and services are intended for businesses and professionals and are not directed toward children.

We do not knowingly seek to collect personal information from children through this website.

19. Complaints

If you believe that Insight has processed your personal information incorrectly, we encourage you to contact us first at:

hello@insightscaling.com

You also have the right, where applicable, to submit a complaint to your competent data protection authority.

For individuals in Portugal, the relevant supervisory authority is the Comissão Nacional de Proteção de Dados (CNPD).

20. Changes to This Privacy Policy

We may update this Privacy Policy periodically to reflect changes to our services, business practices, technology providers, marketing platforms, tracking technologies or applicable legal requirements.

This may include the addition or removal of advertising, analytics, attribution and other marketing technologies.

When we update this Privacy Policy, the “Last Updated” date at the top of this page will be revised.

Where a material change requires additional consent under applicable law, we will seek that consent where required.
